Sweeping Floors on Shabbat (Choreish IV)

Often discussed in the context of Choreish is the issue of sweeping floors on Shabbat.

Levelling or smoothing a surface in a field that is suitable for planting is a violation of Choreish. If done

in a home, it is an offshoot of the prohibition of  building. These concerns refer to a floor made of earth

(not covered in a hard surface like wood or tile). As such, sweeping an earthen flood is prohibited.

The reason is because it is a Psik Reisha - a certainty - that the floors will be leveled. 

What about a floor covered with wood, stone or tile (or any hard surface)?

Rambam is lenient:

רמב"ם שבת כ"א

וְאָסוּר לְכַבֵּד אֶת הַקַּרְקַע, שֶׁמָּא יַשְׁוֶה גֻּמּוֹת, אֶלָּא אִם כֵּן הָיָה רָצוּף בַּאֲבָנִים...

It is forbidden to sweep the ground, lest one levels grooves, unless it is paved with stones.

The Rema takes a stringent view based on the opinion of Tosafot 

שולחן ערוך אורח חיים של"ז

אָסוּר לְכַבֵּד הַבַּיִת, אֶלָּא אִם כֵּן הַקַּרְקַע מְרֻצָּף. וְיֵשׁ מַתִּירִין אֲפִלּוּ אֵינוֹ מְרֻצָּף. {הַגָּה: וְיֵשׁ מַחְמִירִין אֲפִלּוּ בִּמְרֻצָּף

(טוּר בְּשֵׁם ר"י, וּמָרְדְּכַי רֵישׁ פֶּרֶק כָּל הַכֵּלִים, וְרַ' יְרוּחָם חי"ג וּסְמַ"ג וְסֵפֶר הַתְּרוּמָה), וְכֵן נוֹהֲגִין וְאֵין לְשַׁנּוֹת.

2. It is forbidden to sweep the house unless the floor is stone. There are those who permit this even if it is not made of stone. Rem"a: There are some who are stringent even when it is stone (the Tur in the name of the R"i and Mordechai at the beginning of Perek Kol Kelim and Rabbeinu Yerucham Part 13 and the Sma"g and Sefer haTrumah). This is the practice, and one should not act differently. 

As you see, the Rema prohibits even sweeping a stone floor where there seemingly is no concern of

leveling the ground. Why is that? 

The Mishna Berura explains:

משנה ברורה אורח חיים של"ז:ב'

אפילו במרוצף – בין באבנים ובין בקרשים דס"ל דבאין מרוצף הוי פ"ר וגזרינן מרוצף אטו אינו מרוצף ועיין בבאור הלכה:

The Mishna Berura notes that since sweeping an earth floor will certainlyresult in the floor being levelled, there is a rabbinic decree not to sweep ANY floor (even one covered

in a hard surface) lest there is confusion and one mistakenly thinks one can sweep an earth floor as well.

However, the Mishna Berura directs our attention to the Biur Halacha who notes that if all (or most) of the floors in your town are covered with a hard surface, then the concern for mistakes does not apply and sweeping such a floor is permitted on shabbat. 

ביאור הלכה אורח חיים של"ז:ב'

ויש מחמירין אפילו במרוצף – עיין במ"ב דהטעם הוא משום דגזרינן מרוצף אטו אינו מרוצף הוא מסה"ת והעתיקו בט"ז והנה

לפ"ז אם כל בתי העיר או עכ"פ רובם [ריב"ש] מרוצפים באבנים או בלבנים [וכ"ש אם הם מכוסים בקרשים] אפשר דמות

ר לכבד דלא גזרו על רובה מפני מיעוטה ולא על עיר זו מפני עיר אחרת

Bottom line. Since our floors or solid (not earth) one is permitted to sweep them on Shabbat.
